Terms of Service

Please read these terms carefully before using the StreamSailor app or website. They govern your rights and responsibilities as a user of our platform.

📋 The Short Version (Plain English)

✅ You must be 13+ (or 16+ in the EU) to use StreamSailor.
✅ You own your content; you grant us a licence to display it on our platform.
✅ Be respectful. Hate speech, harassment, and illegal content are banned.
✅ Don't cheat, hack, or abuse the platform in any way.
✅ Sailor Coins & subscriptions are real purchases — generally non-refundable.
✅ We can suspend or terminate accounts that violate these terms.
✅ We provide the service "as is" — we can't guarantee 100% uptime.
✅ Disputes are resolved individually — no class actions.
Section 01

Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and StreamSailor ("StreamSailor," "we," "our," or "us") governing your access to and use of the StreamSailor mobile application, website located at streamsailor.app, and all related services, features, and content (collectively, the "Services").

By creating an account, downloading the App, accessing our website, or in any way using the Services, you confirm that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

If you do not agree to these Terms in their entirety, you must immediately cease use of the Services and delete your account.

⚓ Agreement on Behalf of an Organisation

If you are accessing or using the Services on behalf of a company, organisation, or other legal entity, you represent that you have the authority to bind that entity to these Terms, and "you" refers to both you and that entity.

Section 02

Eligibility

To use StreamSailor, you must meet the following requirements:

  • You must be at least 13 years of age (or such higher minimum age required in your country — 16 years in the European Economic Area, 14 years in Spain and South Korea).
  • You must not be prohibited from receiving or using the Services under the laws of your applicable jurisdiction.
  • You must not have a previously terminated StreamSailor account, unless we have granted express written permission for a new account.
  • If you are between the minimum age and 18 years old, you confirm that your parent or legal guardian has read and agreed to these Terms on your behalf.

🚫 Children's Accounts

We do not knowingly allow individuals under the minimum age to create accounts. If we discover an underage account, it will be immediately terminated and all associated data deleted in accordance with our Privacy Policy.

Section 03

Account Registration & Security

To access most features of StreamSailor, you must register for an account. When registering, you agree to:

  • Provide accurate, current, and complete information during the registration process.
  • Keep your account information up-to-date at all times.
  • Choose a username that does not impersonate another person, contain offensive language, or violate any third-party rights.
  • Keep your login credentials confidential and not share your password with any third party.
  • Take full responsibility for all activities that occur under your account.
  • Notify us immediately at support@streamsailor.app if you suspect any unauthorised access to your account.

Account Limits

  • You may only maintain one personal account. Creating multiple accounts to evade bans or restrictions is prohibited.
  • Accounts are personal and non-transferable. Selling, buying, or transferring accounts is prohibited.
  • We reserve the right to reclaim or re-assign usernames that are inactive, misleading, or otherwise violate these Terms.

🔐 Two-Factor Authentication

We strongly recommend enabling two-factor authentication (2FA) in your account settings to protect against unauthorised access. Accounts with 2FA enabled are eligible for expedited support in case of account recovery requests.

Section 04

Acceptable Use Policy

You agree to use the Services only for lawful purposes and in a manner that does not infringe on the rights of others or restrict their use and enjoyment of the Services.

✅ You May:

  • Create, broadcast, watch, and share gaming content that complies with these Terms.
  • Interact with other users through chat, reactions, polls, and squad streaming features.
  • Earn and spend Sailor Coins in accordance with the Sailor Coins Policy (Section 7).
  • Promote your streams on external platforms, provided StreamSailor's branding guidelines are followed.
  • Report content or users that you believe violate these Terms using our in-app reporting tools.

🚫 You Must NOT:

  • Post, stream, or distribute content that is illegal, defamatory, obscene, threatening, harassing, discriminatory, or otherwise objectionable.
  • Upload, stream, or share content that contains graphic violence, adult content, or nudity, unless expressly permitted in designated categories subject to age verification.
  • Harass, bully, stalk, impersonate, or intimidate any person or entity.
  • Use hate speech, slurs, or discriminatory language based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic.
  • Cheat, use hacks, aimbots, or any unauthorised software that manipulates games or the StreamSailor platform.
  • Use bots, scrapers, or automated tools to generate artificial views, followers, Sailor Coin earnings, or engagement.
  • Attempt to gain unauthorised access to any part of our Services, servers, databases, or other systems.
  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App.
  • Transmit viruses, malware, ransomware, or any other malicious or harmful code.
  • Use the Services to conduct or promote illegal gambling, pyramid schemes, or fraudulent activities.
  • Solicit personal information from minors or engage in any conduct that could harm minors.
  • Stream real-money gambling of any kind without our express written authorisation.
  • Use VPNs or other means to circumvent geographic restrictions or account bans.
  • Sell, trade, or otherwise commercialise your account, Sailor Coins, or any other platform feature without our permission.

Violations of this Acceptable Use Policy may result in content removal, account suspension, or permanent termination, depending on severity and frequency.

Section 05

Content & Intellectual Property

Your Content

You retain full ownership of the original content you create and upload to StreamSailor, including stream videos, overlays, profile images, and channel artwork ("Your Content"). By posting Your Content on StreamSailor, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable licence to host, display, transmit, reproduce, adapt, modify (for formatting only), and distribute Your Content solely for the purpose of operating and improving the Services.

This licence ends when you delete Your Content or your account, except where Your Content has been shared by other users or is required to be retained for legal compliance.

Your Representations

By uploading Your Content, you represent and warrant that:

  • You own Your Content or have the necessary licences, rights, consents, and permissions to grant StreamSailor the rights described above.
  • Your Content does not infringe on any third party's intellectual property rights, privacy rights, or publicity rights.
  • Your Content complies with all applicable laws and these Terms.

StreamSailor's Intellectual Property

All content on the Services that is not user-generated — including the StreamSailor name, logo, design, software, features, and all associated intellectual property — is owned by or licensed to StreamSailor and is protected by copyright, trademark, and other applicable laws. You may not use our intellectual property without our express written consent.

Game Content

You are responsible for ensuring you have the necessary rights to stream video game content. Many game publishers permit streaming under their respective game streaming policies. StreamSailor does not grant you any rights to game content owned by third-party publishers.

Section 06

Streaming Rules & Community Standards

All live streams and VODs on StreamSailor must comply with these rules in addition to the Acceptable Use Policy.

Category Rule
Labels & Tags Streams must be correctly categorised by game, language, and appropriate content labels (e.g., "Mature Content" tag where applicable).
Overlays & Music Background music in streams must be licensed for streaming use. Using DMCA-protected music without licence may result in muted VODs or strikes.
IRL Streaming Streaming real-world locations must not endanger yourself or others, expose private property, or record individuals without their consent.
Sponsored Content Paid promotions and sponsorships must be clearly disclosed to viewers using the in-stream disclosure tool or verbal announcement.
Alcohol & Substances Responsible consumption by adults of legal age may be shown, but streams must not encourage excessive use, intoxicated driving, or illegal substance use.
Dangerous Activities Streams must not depict or encourage self-harm, dangerous stunts, or activities likely to result in physical harm to yourself or others.
Moderation Streamers are responsible for moderating their own chat. Failure to moderate persistent hate speech or harassment may result in account action.

⚡ Zero-Tolerance Policy

Sexual content involving minors, terrorism-related content, and content that directly incites violence will result in an immediate and permanent account ban, reporting to law enforcement, and cooperation with legal authorities.

Section 07

Sailor Coins & Payments

What Are Sailor Coins?

Sailor Coins are StreamSailor's virtual in-platform currency. They can be purchased with real money or earned through platform activity (watching streams, participating in events). Sailor Coins can be used to tip streamers, unlock virtual items, and participate in certain events.

Purchases

  • Sailor Coin purchases are processed in your local currency through secure third-party payment processors.
  • All prices are displayed inclusive of applicable taxes where required by law.
  • By completing a purchase, you authorise StreamSailor to charge your chosen payment method.

Refund Policy

  • All Sailor Coin purchases are final and non-refundable, except where required by applicable consumer protection law.
  • Sailor Coins have no cash value and cannot be exchanged for real money, transferred between accounts, or redeemed for cash under any circumstances.
  • If you believe a purchase was made in error or fraudulently, contact us within 14 days at billing@streamsailor.app.
  • Unused Sailor Coins in accounts that are terminated for violations of these Terms are forfeited without compensation.

Subscriptions

  • Premium subscriptions are billed on a recurring monthly or annual basis until cancelled.
  • You may cancel your subscription at any time through Settings → Subscription. Cancellation takes effect at the end of the current billing period.
  • We may change subscription pricing with at least 30 days' advance notice. Continued use after the price change constitutes acceptance of the new price.

⚠️ Chargebacks

Initiating a chargeback without first contacting StreamSailor support will result in an immediate account suspension pending investigation. Fraudulent chargebacks may result in permanent account termination and recovery of owed amounts.

Section 08

Creator Monetisation & Sailor Partner Program

Eligible streamers may participate in the Sailor Partner Program to earn revenue from subscriptions, Sailor Coin tips, and ad revenue. Participation is subject to the separate Sailor Partner Program Agreement, which is incorporated by reference.

  • Revenue share rates, payout schedules, and minimum thresholds are defined in the Partner Program Agreement and may be updated with 30 days' notice.
  • Payouts are issued via the payment method configured in your Creator Dashboard (bank transfer, PayPal, etc.). You are responsible for the accuracy of your payout details.
  • StreamSailor is not responsible for funds sent to incorrectly provided payment details.
  • You are solely responsible for reporting and paying all applicable taxes on earnings received through the Services. We may issue tax forms (e.g., 1099-NEC for US creators) as required by law.
  • Earned but unpaid revenue may be forfeited upon account termination for Terms violations, subject to applicable law.
  • Artificially inflating subscriber counts, tip revenue, or viewer numbers through any means (including bots or coordinated activity) will result in immediate termination and recovery of fraudulently obtained revenue.
Section 09

Privacy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and share information about you when you use our Services. By using StreamSailor, you agree to the collection and use of your information in accordance with our Privacy Policy.

In summary: we do not sell your personal data. We use it only to provide, improve, and protect the Services. You have rights over your data, including the right to access, correct, delete, and export it. See our Privacy Policy for full details.

Section 10

DMCA & Copyright Policy

StreamSailor respects intellectual property rights and expects users to do the same. We comply with the Digital Millennium Copyright Act (DMCA) and similar laws in other jurisdictions.

Reporting Copyright Infringement

If you believe content on StreamSailor infringes your copyright, please submit a DMCA takedown notice to our designated agent with the following information:

  • A physical or electronic signature of the copyright owner or authorised representative.
  • Identification of the copyrighted work(s) you claim has been infringed.
  • Identification of the infringing material and information to locate it on our platform (e.g., URL).
  • Your contact information (name, address, telephone number, email address).
  • A statement that you have a good-faith belief the use is not authorised by the copyright owner, its agent, or the law.
  • A statement that the information in the notice is accurate and, under penalty of perjury, that you are authorised to act on behalf of the copyright owner.

Repeat Infringers

We maintain a repeat infringer policy. Users who accumulate multiple valid DMCA strikes within a 90-day period will have their accounts permanently suspended.

Counter-Notices

If you believe your content was removed in error, you may submit a counter-notice in accordance with DMCA procedures to dmca@streamsailor.app. Note that submitting a false counter-notice may expose you to legal liability.

Section 11

Third-Party Services & Links

Our Services may include links to or integrations with third-party websites, services, or applications (e.g., game publishers, social media platforms, payment processors). These Terms do not apply to those third-party services.

  • StreamSailor is not responsible for the content, privacy practices, or availability of third-party services.
  • Interactions you have with third parties are solely between you and them. We encourage you to read their terms of service and privacy policies.
  • Third-party integrations (e.g., logging in with Google or Apple) are subject to those providers' terms in addition to ours.
  • We do not endorse or make any representations about third-party services accessible through our platform.
Section 12

Disclaimers & Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability, fitness for a particular purpose, title, or non-infringement.
  • Any warranty that the Services will be uninterrupted, error-free, virus-free, or completely secure.
  • Any warranty regarding the accuracy, reliability, or completeness of any content on the Services.
  • Any warranty that defects in the Services will be corrected.

StreamSailor does not warrant that the Services will meet your specific requirements. You use the Services at your sole risk.

Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you. In such jurisdictions, our warranties are limited to the maximum extent permitted by law.

Section 13

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL STREAMSAILOR, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE TO YOU FOR ANY:

  • Indirect, incidental, special, consequential, or punitive damages.
  • Loss of profits, revenue, data, goodwill, or business opportunities.
  • Damages resulting from your inability to access or use the Services.
  • Damages resulting from unauthorised access to or alteration of your transmissions or content.
  • Conduct of third parties on the Services, including other users.

WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN ALL CASES, STREAMSAILOR'S TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO STREAMSAILOR IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $100.

📌 Jurisdictional Note

Some jurisdictions (including certain EU Member States) do not allow limitations or exclusions of liability for certain types of damages. In such jurisdictions, our liability is limited to the minimum extent permitted by applicable law.

Section 14

Indemnification

You agree to defend, indemnify, and hold harmless StreamSailor, its affiliates, licensors, service providers, employees, agents, officers, and directors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to:

  • Your violation of these Terms or any applicable law or regulation.
  • Your Content, including any claim that Your Content infringes a third party's intellectual property or privacy rights.
  • Your use of the Services in a manner not authorised by these Terms.
  • Any dispute you have with another user of the Services.

We reserve the right to assume exclusive control of any matter subject to indemnification by you, at your expense. You agree to cooperate fully with our defence of such claims.

Section 15

Termination & Account Suspension

Termination by You

You may terminate your account at any time by going to Settings → Account → Delete Account in the App or by contacting us at support@streamsailor.app. Account deletion is permanent and irreversible. Certain data may be retained as required by law (see our Privacy Policy).

Termination or Suspension by StreamSailor

We may suspend or permanently terminate your account, with or without notice, for any of the following reasons:

  • Violation of these Terms, our Community Guidelines, or any applicable law.
  • Repeated copyright infringement (DMCA strikes).
  • Fraudulent activity, including payment fraud or artificial engagement inflation.
  • Extended inactivity (inactive accounts may be subject to username reclamation after 12 months).
  • At our sole discretion, for any reason we deem necessary to protect the platform, our users, or our legal obligations.

Effect of Termination

  • Upon termination, your licence to use the Services immediately ends.
  • All Your Content may be deleted from our servers.
  • Remaining Sailor Coins and any unpaid creator earnings will be handled in accordance with these Terms and applicable law.
  • Sections of these Terms that should reasonably survive termination (including Sections 5, 12, 13, 14, and 16) shall continue to apply.

📢 Ban Appeals

If you believe your account was suspended in error, you may submit an appeal within 30 days of the suspension at appeals@streamsailor.app. We will review your appeal within 14 business days. Our decision on appeals is final.

Section 16

Governing Law & Dispute Resolution

Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which StreamSailor is incorporated, without regard to its conflict of law provisions.

If you are a consumer in the EU or UK, you also benefit from any mandatory consumer protection provisions of the law of your country of residence.

Informal Resolution

Before filing any formal dispute, you agree to first contact us at legal@streamsailor.app and attempt to resolve the issue informally for at least 30 days.

Arbitration

If informal resolution fails, disputes (other than those in small claims court) will be resolved through binding individual arbitration, not in court. By agreeing to these Terms, you waive your right to a jury trial and your right to participate in any class action or representative proceeding.

Class Action Waiver

YOU AND STREAMSAILOR AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

🇪🇺 EU / UK Users

If you are a consumer resident in the European Union or United Kingdom, you are entitled to bring proceedings in the courts of your country of habitual residence. Nothing in these Terms limits your statutory rights as a consumer in your jurisdiction.

Section 17

Changes to These Terms

We may modify these Terms at any time. When we make material changes, we will:

  • Update the "Last Updated" date at the top of this page.
  • Send an in-app notification and/or email at least 14 days before the changes take effect (30 days for material changes affecting existing paid subscriptions).
  • For significant changes, display a prominent banner in the App requiring you to acknowledge the updated Terms.

Your continued use of the Services after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Services and delete your account before the effective date.
